Acceptance of Terms
By accessing or using Showfluent (the "Platform"), you agree to these Terms & Conditions ("Terms"). If you are using the Platform on behalf of a brokerage or team, you represent that you have authority to bind that organization, and "you" refers to both you and that organization.
Description of Service
Showfluent is a showing-operations platform for real estate brokerages and agents, including branded showing tours, open house guest capture, showing feedback collection, seller activity reporting, listing management, and an AI assistant grounded in your account's own data. Showfluent is under active development. Icon Realty Advisors is participating as an early beta brokerage while the product is refined for broader brokerage use; features may change, and some capabilities are still being developed and tested.
Accounts & Eligibility
You must be at least 18 years old and capable of forming a binding contract to use the Platform. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Brokerage administrators are responsible for the agents they grant access to.
Listing Data & MLS Compliance
Listing data displayed on the Platform is provided in compliance with applicable MLS integration and licensing requirements and is sourced from the relevant multiple listing service(s) and/or a licensed data provider. Property information is provided for the purpose of scheduling and conducting showings and marketing listings, is refreshed periodically, and is believed accurate but is not warranted. Redistribution of MLS-sourced data outside the Platform, or in a manner inconsistent with the applicable MLS's rules, is prohibited.
Your Content & Communications
You retain ownership of the content you submit to the Platform (listing notes, buyer information, feedback, templates, and similar). You grant Showfluent a license to host, process, and transmit that content as needed to provide the service (for example, generating and sending tours, feedback requests, and seller reports on your behalf). You are solely responsible for having the necessary consent or an existing business relationship to text or email anyone you contact through the Platform, and for complying with applicable communications laws (including the TCPA, CAN-SPAM, and similar state and federal rules). Showfluent provides the tools; you are responsible for how you use them. See the Acceptable Use Policy for more detail.
AI Features
Showfluent includes AI-assisted features (for example, Ask ShowFluent, AI-drafted seller report summaries, and feedback theme summarization). These features are grounded only in your own account's data and, where relevant, ShowFluent's own documentation — not in open web content — and are designed to avoid inventing facts. AI-generated content may nonetheless contain errors; you should review AI-drafted material (such as seller report narratives) before relying on or sharing it. We do not submit your account data to third-party model providers for the purpose of training their general models.
Acceptable Use
Use of the Platform is subject to our Acceptable Use Policy, which is incorporated into these Terms by reference.
Proprietary Platform
Showfluent and its associated branding, workflows, generated document formats, and underlying software are proprietary to Showfluent. Except for the content you own and submit, unauthorized reproduction, redistribution, or reverse engineering of the Platform or its generated output is prohibited.
Fees
Fees, if applicable to your account, will be set out in an order form, invoice, or separate written agreement between you and Showfluent. During the beta period, participating brokerages may use the Platform under the terms separately communicated to them.
Disclaimers
The Platform is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Showfluent does not warrant that the Platform will be uninterrupted, error-free, or that listing, MLS, or AI-generated data will be complete or accurate.
Limitation of Liability
To the maximum extent permitted by law, Showfluent will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the Platform. Showfluent's total liability for any claim arising from these Terms or the Platform will not exceed the amount you paid Showfluent in the twelve months preceding the claim (or, during the free beta period, one hundred dollars).
Indemnification
You agree to indemnify and hold Showfluent harmless from claims arising out of your misuse of the Platform, your violation of these Terms or applicable law, or content you submit or communications you send through the Platform.
Termination
Either party may terminate access to the Platform at any time. Showfluent may suspend or terminate accounts that violate these Terms or the Acceptable Use Policy. Upon termination, your right to use the Platform ends, though provisions of these Terms that by their nature should survive (including Proprietary Platform, Disclaimers, Limitation of Liability, and Indemnification) will continue to apply.
Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles, and any disputes will be resolved in the state or federal courts located in Florida.
Changes to These Terms
We may update these Terms from time to time. Material changes will be reflected by updating the effective date above. Continued use of the Platform after changes take effect constitutes acceptance.
